Research On Commutation Procedure

Commutation, after nearly a century’s development in China, now has became an important execution system in the socialism legal system of China. Recently, the prison system has been working on the improvement of commutation system. The substantive rules of commutation litigation are already well-defined and quite regulated, while it still lags in procedure part for some reasons. As an important protection for the justice of commutation system, commutation procedures have not been given its due attention. For the purpose of increasing public’s understanding of commutation and the system, and making the whole execution system a more perfect one, the author hopes to seek the ways to improve Chinese commutation system through the introduction of current commutation of China and the description of execution theory.This paper is consisted of4parts, firstly the main introduction to commutation procedures, then the discussion about the rightness of commutation, thirdly and also the essential part is the description about commutation procedures in China and analysis on the shortcomings, and the last part raises some suggestions about commutation procedures.
