On The Protection Of Labor Rights And Interests Of College Students

In recent years, with the development of economy and society, standard of talents becomes higher and higher. It has become the social bottleneck for the undergraduates to find a job. And it also becomes another vital task for undergraduates to get a concurrent post due to be familiar with operational environment as well as deal with financial problem. Thus it attracts much attention of tort cases of undergraduates’ part-time jobs. However, due to imperfection of labor law, as well as many legal loopholes, judges and scholars have different opinions for whether to apply labor law for part-time jobs, and it also causes different codefendant in practice. On the accountant, this paper analyses it should be applied by labor law from a perspective of applications of law. And the paper also propounds to build labor and social security system for the current undergraduates draws on the experience of overseas’ regime of law. The author hopes to offer a hand for the foundation of the institution.The paper is divided in the following three parts:The first section is about two cases that appear different codefendant and analysis about the grounds of decision. And it raises the proposition of the paper-the undergraduates should apply labor law during part-time jobs. It also analyses current situation and reason for the violation to labor rights.The second section is to analyze the enterprise nature of undergraduates’ part-time job from labor law subject and legal relationship on theory of law and lead to the point that part-time job should use labor law.The third section is labor law and policy overseas, and proposes the idea to build undergraduates’ labor protection system, and propounds overall goals and construction scheme to the system.
