Study On The Imputation Of Carrier Of Sea Cargo

The system of liabilities of carriers has always been one of the most distinctive systems in international shipping conventions, and in particular, the criterion of liabilities of carriers highlights the distribution of risks between the carriers and cargo owners during carriage of goods by sea, which also determines the values of laws of carriage of goods by sea. In recent years, with regard to the criterion of liabilities of carriers, whether the incomplete fault liability principle set in Hague Rules, or the complete fault liability principle shall be adopted has always been the focus of attention in international shipping community, on which different judgments have been passed thereby. And there is the same situation with the criterion of liabilities of international shipping carriers here in China. The articles builts its theory on the basis of the sources and categorization of criterion of liabilities in Civil Law, and starts to analyze the criteria of liabilities contained in the4current major international shipping conventions as well. In Summary, this article explores the criterion of liabilities of carriers in international carriage of goods by sea.
