European Practice has proved that the overall planning and management of the watershed as a unit is one of the most effective way to water resources management. At present,the water resources in China meet with many serious problems like the severe shortage of water, low efficiency of water use, the serious water pollution, and the ecological degradation of rivers and lakes. Today, water security has been raised to an unprecedented height, strengthening watershed management legislation and improving it’s legal system is an important guarantee for the sustainable use of water resources in China.The paper adopts a comparative study, empirical analysis, inductive study method and other methods for some simple discussion of watershed management legislation. The study intends to focus include the following components:Part1is the introduction of watershed management legislation related to theoretical issues; Part2is the analysis of watershed legislation of the EU and major European countries; Part3is the analysis of watershed legislation Status and Problems of China, and the achievements and shortcomings of the Taihu Basin management legislation; Part4is a comparative analysis of EU-China River Basin legislative and management system, and the advice of improving the watershed legislation in China.Through a comparative analysis, we can draw some conclusions. Firstly, we must change the concept of watershed management as a broad concept, enact "Watershed Management Act" with a clear guiding ideology of unified watershed management. Secondly, we should amendment the existing water regulations, carry out specific watershed legislation, improve watershed management regulatory system and related systems. Thirdly, we should establish an efficient watershed management system, give the rights of decision-making, supervising, coordinating and implementing to basin management institutions.
