Research On The Related Issues Of Inheritance Reply Requests

Requesting right of restoring inheritance plays an important role in inheritance law.It is clearly coded by legislation in many civil law system countries, however ourcountry didn’t make it real for legislation. Therefore, for the stand of better protectingthe benefit and interest of heir, we should set up and improve the system of requestingright of restoring inheritance so that it can deal with the increasing disputes ofinheritance in modern society.In this paper, through the example of Hou Yaowen ‘s heritage,we analyze thecase and its theory. And based on that,I analyze how dose it work and how to protectthe inheritance, at last, I take a proposal from the legislation of other countries to makeit functional to protect the rights of inheritance.
