Modern society is the risky society, all kinds of emergencies occur frequently, notonly greatly threatens the national security and social stability, and also caused greatdamage to the people’s life and property.To establish perfect emergency managementsystem to solve the various emergencies, is extremely important for all countries in theworld.The emergency response law enacted in2007,marked the emergencymanagement in our country has entered a new stage full of rule by law.And our countryhas entered the period of social transition, the government need maximum guaranteecitizens’ rights when they use emergency administrative power to solve all kinds ofemergencies.This paper analyzes the government’s function in dealing with emergencies,according to the present situation in the process of our government disposal of theemergencies.And based on national conditions,put forward several measures to build theadministrative system of emergency procedures to regulate the governmentpower,through the procedural justice to protect the rights and freedoms of people aswell as the effective execution of the power of the government.
