A Study On The Practical Operation Of The New Review And Prosecution Procedure

The review and prosecution in People’s Procuratorate plays an important role inproper prosecution, violations detecting and rectification of investigation activities,which is also a basic preparatory work for the implement of the public prosecutionfunction and an important means of legal supervision of investigative activities. Thenew review and prosecution procedure has been put in practice for more than one yearsince January1,2013. Whether its implementation status has achieved the purpose ofcrime punishment and human rights protection is still a question to be explored. Inthis paper, empirical investigation and research is carried on the implementation statusof the new review and prosecution procedures, the experiences obtained and problemsencountered within it, in juye County People’s Procuratorate of Heze City, ShandongProvince. Based on the first-hand data collected from the empirical research byinterviewing, paper and electronic documents collection and research, etc., the paperanalyzed the implementation status in juye county, summarized the “juyeexperiences”, and also constructive advices were made to deal with the problemencountered in the implication.
