Practical Research On Intellectual Property Protection Of Intangible Cultural Heritage

With the development of economy and the advocacy of national culture especially for the protection of intangible cultural heritage,folk literature and art with national and local characteristics is accepted by everyone.The huge cultural and commercial value of the intangible cultural heritage has attracted the attention of the society.The economic value of the intangible cultural heritage is highlighted in the market operation, but also led to the infringement of intellectual property rights are not uncommon.Many of the intangible cultural heritage with unique local characteristics, condensation of the wisdom of a particular group and with some of the characteristics of intellectual property.However,it is difficult to determine the right subject and originality of the technology of intangible cultural heritage under the existing intellectual property system.Through case analysis, this paper discusses the practice of intellectual property protection of intangible cultural heritage in Shanghai. Suggestions are put forward on the protection of intangible cultural heritage intellectual property:First,improve the laws and regulations;Secondly, clear the responsibility of the government;Third, establish and improve the market rules;Fourth, strengthen government supervision;Finally, encourage the active participation of social groups in this.
