Private education is an important component of the socialist education system with distinct Chinese characteristics. That since the law "on the promotion of private education, People's Republic of China", and the implementing regulations having been issued let the government give the private education more autonomy to run schools independently, and standardize the running-school behavior further, forming the basic legal framework of making healthy and orderly progress on private education. However, owning to the shackles of notions and systems, the development of the private education in China faces a good many plights, such as too much governments'supervision, serious resource monopoly, conspicuous planning system signs, etc. With the diverse, cooperative, participative, responsible and lawful educational governance mechanism becoming a consensus day by day, researching system obstacles in practicing and exploring and realistic ways to breach them are imminent.The adhering to the commonweal of education strictly, the scarcity of the educational resources, the externality of the education and the complexity of the educational capital source make the stipulation of the possession, ownership, use, usufruct, disposition and some other behavioral rights of private education property become necessary. This study establishes a research framework at the property rights level and selects the public goods theory, the theory of property by Coase and the theory of limited government as theoretical tools to analyze the current situation of the private education property rights, seeks to find and solve the unscientific and defective part in the property rights institution and explore what and how the government should do in constructing property rights institution of the private education and completing the management system of education and offer some feasible countermeasures and proposals.At present, questions of the private education property rights are mainly distributed in three aspects-deletion result from the definition that is made to property rights by some relevant laws and regulations, unclear vesting of property and tentative property right operation. Concerning the practice of education system reform in China and abroad valuable mature matures, this study considers establishing clearly established ownership, well-defined power and responsibility, strict protection and smooth circulation modern property rights institution of private education is in need of the government changing its functions, changing control into management, resorting market forces, social forces adequately, perfecting relevant laws and regulations, to strengthen policy support and financial assistance, strengthen the property management and asset audit, making a good coordination of the interest among national, private schools and sponsors, improving government-funded education of macroeconomic adjustment mechanisms, promoting and constructing property operating mechanism, constructing administration, responsible government, and in order to construct a good developing environment for the private education.System is not everything, but we can do nothing without it. The system always relies on some sort of punishment or encouragement to be continued, and thus it will import human behavior to the track that can be reasonably expected. The design for private education property rights system not only will promote the development of the entire social education career to be normalized, and its significance goes far beyond specifying prospects and direction for private education, promoting the development of its own health orderly, but also designing and providing a sample for the property rights system of the entire education system in the future.
