Nowadays, China is on the way of social transformation. The structure of our society is changing rapidly and the gap in the stratums is becoming more and more prominent. These are not only to prove to be the important factors of higher educational fairness, but also to be the main performance of unfairness. In the process of higher education, exists stratum gap inevitably, whether the educational resources share, the educational years or the practice opportunities. Although regular gap is reasonable and necessary, by the promotion of a series of unreasonable factors, such as the allocation of higher educational resources system, charge system. These unreasonable factors expand the educational gap and hinder the pursuit of fairness seriously. Besides, doing the good job on the aids of poor students is the necessity of higher educational fairness. But if the existing aid system is not perfect, the students' needs will not be satisfied, it is also unfair to them. Under the background of social stratification which exists objectively, the real educational fairness doesn't exist, but the pursuit of it will not stop forever.On the basis of recognizing and estimating the stratum gap which exists objectively in the process of higher education, through transforming John Rawls' principles of justice into the educational principles of justice. the essay uses these principles as the theoretical basis of the last part of it, in order to explore the effective ways to narrow the educational gap, reduce the constraints of higher educational opportunities by the students' stratum origin, and finally to realize the higher educational fairness in the greatest measure.
