Study On Public University's Interior Regulation In Our Country

With continuous sue cases and other dispute,people begin to review the university rules.Under the background of ruling education and school in law,it's necessary to investigate university rules from the perspective of law.Through researching the law problems in public university,we can not only develop the theory of ruling schools in law and provide helpful guide for the school administration,but standardize the running of school and protect the right of university staff.This paper begins with the concept of public university rules.Public university rule, set in terms of national education law or policy,is a generic term of normative document. Public university rules can be classified differently according to objective audience, constitutors and purpose,which is helpful to grasp the denotation of public university rules from different perspectives.This paper mainly focuses on analyzing the character of public university rules.In terms of law characters,public university rules are not the representation of our law,but they play the role of legal norm.So we can regard them as law extension.Part of public university inside rules can be regarded to hold the character of public law.In the fourth part,it explains the effect of university rules for every principal.The next part is about the analysis of regulating right for the public university rules.In theory, there are different principals,but in practice,the difference from theory is obvious.The problem of losing right in academic and democratic department is pressing and needs us to improve the organizing law.The paper ends with discussing the supervision of public university rules.Judicial supervision means that in the course of administrative action,judges examines the effectiveness of university rules.Administrative supervision is performed by educational administrative institution,including administrative record audit and complaint and adjustment audit.The supervision in university should be taken seriously.Firstly,we should improve the legislation and then make the staff and university counselor play the role regular supervision.
