Higher education bear the burden of training talents, it plays an important role in the modernization. The 17th Chinese Communist Party National People's Congress Clearly put forward priority to develop education,improve the quality of higher education, construction human resources power. Since reform and opening up, China's higher education undertakings have developed rapidly, to all areas of society to provide a large number of high-quality talent, but at the same time as systems and the reality of the restraints there are still some problems: College management system lacks flexibility, and management efficiency is not high; Universities autonomy is not strong; college and university leadership appeared frequently the problem of corruption. These problems largely due to unreasonable commissioned by the principal-agent relationship, and their very distinct emerged with the deepening structural reform of economic and political. Under the new form,we should clearly recognize the form, from the thought, the mothion and so on various aspects makes the reply, can initiative which wins in the higher education global competition.This article based on principal-agent theory, combination of information economics and game theory, make use of many methodes such as multidisciplinary research methodes, literature methodes,comparative analysis methodes, analysis of the current higher education system, including the status the management of public higher education institution from the perspective of government and university leaders. On the basis of previous studies identified the reasons for caused China's public higher education institution principal-agent relationship low efficiency of operation, it is in essence the administrative clientage, the main cause the status of clients and agents is not clear ,acting chain is too long and supervision and encouragement mechanism is not sound. And use a solution to the problem of agence, for china's special conditions,make use of system theory analyse relations of public higher education institution and society as a whole system,look at the same the two sides agency, and strengthen the supervision of the client and introduction of public participation system. Assimilate the first-class university of foreign management models, with the status quo of China's higher education and higher education and the special nature and the law ,and creativity put forward the measures regulate principal-agent relationship of the Chinese public higher education institution. These measures from the micro and macro level conducted a comprehensive diagnosis of China's public higher education institution: deepening the reform of the mechanism for the higher education system, establish and perfect the schools and the Government to assess scientific and effective supervisory system, establish and perfect a modern university system, strengthen the public higher education institution and government personnel agency work, and improve the client and agent's incentive system, the introduction of the third sector on the implementation of clients and agents supervision.Finally,the article gives the pictures of this issue in the future.
