Reform and open policy have carried out for more than 20 years. Our higher education development has obtained the achievements that attract worldwide attentions. The number of the university has increased largely, and the universities had trained many high-level talented persons which batch of adaptations economies and the society develops needs, and becomes the important constituent of the national science and technology innovation system. The higher education popularity, internationalization and socialization have enhanced day by day. It has become the mutual recognition that vigorously develops the higher education, enhanced the quality of the higher education, and construct the world first-class university. And the call of the university school rights which to independence also more and more high, it is very important to establish a higher education management system which is reasonable, effective and legally. And if we want to achieve all those things, the first thing we must to do is to establish Statutes of the University. The Statutes of the University have played a very important rule in the development of the university. It not only is the legitimate foundation that the university sets up, moreover is the link, which connects the university and exterior society. The Statutes of the University also is the university self- government charter, it makes the action legalization which society to participate in the university, and it has the extremely vital role in innovate the modern university system.The present paper used the education research techniques such as historical analytic method, literature law and comparison analytic methods and so on. In the first part it has carried on the analysis in the main text to the Statutes of the University concept as well as the correlation concepts, and analyzed two viewpoints which is about the university regulation formulation main body is "conducting" or "school itself", moreover proposed my own viewpoint. Finally in this part has carried on the quite detailed analysis on the function of the Statutes of the University.In the second part, it was detailed about the appearance of our Statutes of the University, the development of it. It is comparative analogized between "Beijing Normal university School Regulation" and "Plays towards the time Decides Big School Regulation"; it was appeared a statutes of the university which is similar with today's university regulation in The Republic of China time, it is name was "Xiamen University Program", it is the beginning of the term when our universities make their own statutes of the university. It has the extremely important research significance, it has also carried on the comparative analysis in the article; The third time is our country planned economy times, it is analogized about "higher education 60" Finally has carried on the description in this part to our country present situation of the Statutes of the Universities.The third part has analyzed characteristics of the universities which have the Statutes .the characteristics are: These university regulations unify the school's actual situations, it has carried on the comprehensive stipulation to the school's guiding ideology and the localization and the characteristic, school management aspect and movement mechanism, school's teaching scientific research and rear service, teacher and other educator, student, funds property and financial control and so on. It is basically manifested has followed which general of the higher education rule and display the principle which the school's individuality unified, it had the certain in notation. But our e universities which had regulations also has some problems, for example, the legal status is not clear, the deficient procedural nature stipulated, operational is not strong, deficient individuality characteristic and so on, it has carried on the brief analysis in the paper to these questions.The last part of the main text is aims at the questions which the preceding part proposed to put forward some proposals, including: Enhances people's understanding about the university regulation, people including the university internal function organization and the administrative personnel as well as all teachers and students staff. About the university regulation's formulation and the revision procedure, the university regulation formulation needs to follow the right procedural principles, the right procedure principles include: public principle, fair principle, participation principle, efficiency principle. In the university regulation content stipulated on includes: follows the higher education rule, and unify the sense of principle and the disposition, correctly exercises the school right to independence and the academic freedom power, widely solicits the general teachers and student's opinion, both profits from the foreign experiences and to inherit our country university regulation's unique origins; finally is to surveillance and appraisal university regulations and so on.
