High quantity of teaching service is always scare products in the higher education market,so as practical suppliers, higher teachers certainly become pursuing targets of higher schools. According to exclusion of private ownership, higher teachers and higher schools separately seek and then reach precontracts of property rights of partial higher teachers, that is faculty contract. Faculty contract turns exchange of ownership from market exchange to repetitious games of property rights in higer scools ,so arrangement of ownership is the core of the contract.Because higher scool faculty property rights are special, higher school faculty contract is inevitable incompletely. On overcoming the risks in faculty contract, many internal scholars put forward some incentives based on the principal- agency theory. But they are imperfect. Because according to theories of new institutional economics,contract theories not only include principal-agent theory,but also include transaction cost theory and incomplete contract theory,and exactly the former gets around intentionally the ill__defined property rights,and this means that they give up the essence that the faculty contract is the arrangement of both two sides property right transactions.so these can't resolve the faculty encouraging problems which exist in faculty working process. This dissertion takes the faculty contract as research object, making use of the related contract theories of new institutional economics, using property right analy as the analytical core of facuty contract,on faculty incomplete contract,by the reasonable arrangement ill__defined property rights I wish to encourage faculty human capital output,to reduce transaction cost,to encourage faculty working actively.This dissertion is constituted by four parts:Part One intrduction analyzes some definitions on contract, property rights, the transaction cost, the incomplete contract and the theories of complete contract, the transaction cost theory, incomplete theory.
