With the rapid development of higher education, various universities teaching branch and library purchasing fund increases unceasingly, library of university teaching and with demand was high. Many businesses looked university as "the big cake", the commercial bribery in the procurement has intensified trend. The University Library of exclusively involved in the procurement of commercial bribery is rare, therefore, there are many problems in judicial practice. First of all, university library procurement of commercial bribery offense finds that many problems exist in practice, different standards, the lack of accurate characterization of the theory sorted out urgently. Second, when the colleges and universities accounted for the teaching materials, books, discounts and rebates, which often violate systems and standards related to state and deliberately, set up a "small treasuries" or "extra accounts", in order to circumvent the regulations and to avoid regulation. Again, there are many problems in the commercial bribery of University Library purchases.In this article, the author has linked the theory of criminal law with the practice of actual judicial,in the basis on analysing the defects in the legislation charges in an indictment formulation,studied in a deep-going and main knotty problem in actual judicial practice, hoped that it will guide the practice of actual judicial,accurately wield the weapon of corporal punishment,punish commercial bribery a crime,defend regular financial order of the students and colleges. In this article,university library purchasing divided into five parts, textbook purchasing and library acquisition. Such as university teaching materials, books dealing with procurement, accounting discounts should be in accordance with the relevant provisions of laws and regulations, all on the content of the discount to the school finance.
