Government procurement is an important means of the world's governments to manage social and economic life. Government procurement system was formed around the late 18th and early 19th century in Western capitalist countries, so far it has more than 200 years of history. Government procurement system can be divided into three periods. The first stage:the late 18th century to World War II, marked by the establishment of stationery Supply Authority of British Government in 1782, is the formation period of government procurement. The second stage:from World Warâ…¡to the late 20th century,70s, is the formation period of the government procurement. During this period, government procurement not only became a way of optimizing the financial expenditure the Government, also was the government's macro-economic management tools. The third stage:from the 20th century era of late 70 until now, this period is characterized by government procurement more global. China's thinking about government procurement is very old, in the Western Zhou Dynasty there was historical records on the government regulated the use of public funds to purchase goods price. While our government procurement system has existed since ancient China, however, the implementation of government procurement system sybolized by open market competition began in 1995. Compared with Western government procurement history which more than 200 years, government procurement practices in China are not quite mature.In order to better the allocation of market resources in the global range, to follow the rules of market economy, to break the trade barriers between countries, to promote economic prosperity and development of countries in the world, World Trade Organization was seted up. However, the government procurement agreement is not integrated into the "package" program, but concluded the "WTO Agreement on Government Procurement," by more than 30 countries.As one of the WTO's Plurilateral Trade Agreements,the members of WTO have the right to choose to join, only the joined members are binded by the agreement. Therefore, government procurement is essentially separated from world trade, based on the actual situation in the country, the members may give foreign suppliers discrimination in different degrees. As economic integration and deepening of trade liberalization, the amount of funding of the Government's annual procurement rising gradually. China, the world's largest developing country, when joining the WTO, it committed to the Member States will join in "WTO Agreement on Government Procurement" as soon as possible, as the observer, China launched the negotiations program to join the Agreement in December 2007.This article is divided into four chapters. The first chapter from the basic concept of government procurement, introduces the definition, characteristics and types of content government procurement; The second chapter introduces the main content of "WTO Agreement on Government Procurement". It elaborates from the objectives, principles, scope, procurement, dispute settlement mechanism. The third chapter introduces the content of the Draft for Comment on "Implementation Regulations on Government Procurement"(hereinafter the Draft) which is drafted lately. Compared with the original Government Procurement,it introduces the new or significantly change in the content of the Draft. Chapter IV, The comparisons between "WTO Agreement on Government Procurement" and the Government Procurement Law separately from the basic principles, scope, procurement, dispute settlement and other aspects to obtain what areas we need to improve, and strive to modify certain provisions to jconform to provisions of the Agreement before join the agreement. Chapter V, complete measures of domestic government procurement law. Based on the previous four chapters, combined with the content of Draft for Comment on "Implementation Regulations on Government Procurement",make some conceive on improving the domestic government procurement law,highering Government Procurement barriers appropriatly, speeding up the training on the competitiveness of domestic enterprises, giving priority to buy domestic products and safeguarding the interests of national industries.
