| As the title of the thesis"On Threat Behavior of Criminal Law", start with the stipulation of threat behavior and the existing problems, further study on the definition of threat behavior, and relation with following behavior, to benefit the research of criminal legislation, criminal justice and the theory of criminal law .the whole thesis is composed of three parts, beside foreword and conclusion. The first part is on the existing problems and the stipulation of threat behavior in criminal law. It mainly focus on the category of threat behavior, including the classification based on method of threat and structure of threat behavior. There are problems , such as massive threat behaviors which do harms to citizen's spiritual calm and personal freedom seriously are excluded from rules and regulations of criminal law, not closely connects with administrative law, disunity standard of condemnation on threat behavior. The second part defines the threat behavior from a perspective of criminal law, tells the difference between coerce violence, menace, threaten and force; describe the characteristic of threat behavior, including urgency for threat behavior, victim, disadvantageous consequences and method to notifications disadvantageous consequences. Analyze the relationship in among of threat behavior, the following behavior, purpose behavior, behavior of encasing threat. Define several kinds of special threat behavior. The third part is a complete of the model of legislation for the threat behavior in criminal law, by the research of the stipulation of threat behavior in continental legal system and the common law system; clarify the necessity of the crime of threat or the crime of coercion. Approach how to perfect the rules of threat behavior from different angles. To better protect personal freedom, especially citizen's spiritual calm, massive threat behaviors which do harms to citizen's spiritual calm and personal freedom seriously ought to be included in rules and regulations of criminal law, which provides full protection for human rights. |
