The Research On Regulation Of Internet In China

Internet is one of the greatest creations of human civilization in the twentieth century. After several decades of development, it has moved from a pure academic exchanges and military-technical means arid tools into the social, economic and all areas of life, evolving techniques and tools for business, education, research and management,becoming an integral part of people's real lives,making the world into an organic whole link. Just because of this, when people enjoy the convenience of the network,they are also facing new problems and hidden dangers brought by it at the same time. In the new century, network security issues emerge in endlessly. How to regulate the network efficiently has become rather urgent and tough issues that the government faces in all countries.The first part of the article is to explain and elaborate a few basic concepts about Network Control. Network Control does not come up at the same time with the network, but the proposed concept with the further development of the network. Cyberspace differs from the real world, it is the network features that lead to the particularity of the control in the final analysis. With the same principle,the network control means and methods must accord with the network characteristics. An important aspect of network control is the source of network information--- a variety of network service providers, so the concept of network service providers must be clear.The second part focus on the analysis of China's network control actualities. We start with the concrete analysis of all parties involved in network control law relationship in our country,especially the analysis on the main body of the network control.First of all, clear the government's position and functions. Secondly, clear network control fuctions of the trade associations,particularly the analysis of Internet service providers's control actualities rencently in our country.The third part is a detailed analysis of the foreign network control model features. It mainly introduces the recent world's three main management mode, and makes classified comparisions about the important similarities and differences that all kinds of models refer to.There must be clear rules and principles about the control of network service providers,whether to make a choice of strict liability or fault liability is decided according to the actual circumstances of control in the country. Countries in the world have come to a consensus on network control to strengthen international cooperation,aiming at meeting the common needs of network development.The fourth part makes suggestions about improving our country's network control model from four aspects which are the Internet legislation, network technology, industry self-discipline and strengthening Internet user's moral and cultural construction.Internet regulation is a new course based on network's own features and come up with the network development.With different countries having different situations,it leads to that the concept of network control, methods and other areas are not totally the same. This article hopes that we can clarify and improve the network control theory on the basis of tidying up,analysing and researching the conditions of network control at home and abroad and make reasonable suggestions about the improvement of our country's regulation model connecting our country's internet regualtion activity.
