Imperial Examination System was abolished in the later Qing dynasty of China. But the recruit of capable person should be continued with the development of our society. As a method of selecting talents, examination is bound to be the way for the sustainable development until we can find a better one. Sun Yat-sen attached great importance to the examination system, test legislation. He submitted the proposals for"constitution of five powers"and the establishment of the Examination Institute .Under the guidance of his right thought, the examination legislation in the period of the Republic of China has been gradually improved. It has exerted positive effects on civil service examinations.The paper first discusses the transition of examination system of modern China and puts emphasis on the boom of new school education and the impact under the guidance of Sun Yat-sen's right thought in new examination system and examination legislation. Meanwhile, the course of the examination legislation of 4 different periods then is reviewed. We also have a short show about the brief comments on exam legislation in the period of the Republic of China. After that , we will find : the scientific and perfect examination legislation then can serve as a tight legal exam system to select the talents, which played a good role at that time. However, because of the arbitrary rule of the KMT Government and wars, it did not work well.With a long history of examination, China still remains the same today. The current examinations are of great variety and extraordinary size, involving a lot of people's rights, and even affecting the overall development of our society. As a result, it is import for us to develop a legal examination system on the basis of scientific and rational planning. But the existing problem is not only the lag of legislative adjustment and low-level aspect there, but also the undeveloped legal system in exam. Such state can not meet the development needs of examination in China today ,even hinder social development seriously. We should be inspired by the teaching of the legal system during the Republic of China, perfecting them to realize the test rules by lawThe research of the legal system is of certain reference value for examinations in recruitment for public service. It is helpful for us to guarantee the fair competitions of test, and to make sure the test are open, fair and just. In this way, we can select those who are best qualified. and can exert the function of examinations to our greatest limit. This principle can also guarantee the rights of examinees. More importantly, it has played active and driving roles for our society to develop.
