The Research On The Legal System Of Administrative Supply

The administrative supply is one of the important characteristics in modern administration, which mainly focus on protecting the rights of social vulnerable groups and provides conditions and possibilities for them to survive and develop. As the state actively promotes the new developing concept featuring people-orientation and proposes the idea to build a socialist harmonious society, more and more social concerns are concentrated on realizing citizens'rights to enjoy the material assistance and other relevant beneficial right. In recent years, scholars have gradually started to conduct in-depth study on the legal system of administrative supply, which serves as an important means to protect these rights.The paper is divided into four chapters except the Instruction(Chapter 1) and the Conclusion (Chapter 6):Chapter 2, the basic theoretical issues on administrative supply, which analyzed the main concepts, expounded characteristics, features and functions of the administrative supply, as well as discussed the theoretical foundations of the administrative supply; Chapter 3, the comparative analysis of foreign legal systems of administrative supply, which introduced legal systems of administrative supply in Western developed countries and prescriptions relating to the legal system of administrative supply in international conventions, as well as obtained the reference to China's legal system of administrative supply through analysis and comparison; Chapter 4, deficiencies and problems existing in legal norms and practices of administrative supply, which are proposed by studying the developing situations of legal system of administrative supply and considered profoundly; Chapter 5, the basic ideas to improve China's legal system of administrative supply, which is put forward by the above analysis and exposition.In this paper, the innovation is focused on two aspects:Firstly, from the research prospect, this paper proposed the theoretical basis for protecting human rights of administrative supply and paid great attention to the impact of administrative supply on rights of the administrative relative persons in view of human rights; Secondly, from the prospect of the basic thinking to improve China's administrative supply system, the paper expanded the administrative supply to the protection of social rights and other beneficial rights, and proposed to improve the basic thinking to improve China's administrative supply system from aspects of legislative perfection and system perfection.
