| Service plays a very significant role in domestic civil procedure. It influences whether proceedings could operate in a normal way or whether parties'interests during proceedings could be fully ensured. In china, because of the obsolete ways of service, inefficiency and the unsatisfactory effects, the service delivered by courts has always been faulted. Not only have courts'judgments been affected by inadequate service or delay, but also the realization of parties'litigation rights has been handicapped. Trying to solve these problems, the author proposes to popularize the electron service in China. Compared with traditional service, electron service has many advantages such as time-saving and high efficiency. Along with the development and popularization of computer technology and Internet technology, electron service will be adopted more and more often in the judicial practices of China. Based on this understanding, such article is focused on discussing how to construct the legislation of electron service which suits China well. Electron service will, solve the current problems existing within domestic civil procedure service, and most importantly, hasten the match-up between the development of domestic civil procedure and the world's civil procedure.This article is composed of four chapters. Chapter one is a summary of electron service in civil procedure. It introduces the definition, characteristics and status of electron service, the technological environment electron service relies on as well as the significance of popularizing electron service in China. Chapter two analyses the obstacles in promoting electron service in domestic civil procedure from the following four perspectives: legislation, technological environment, court administration and social concept. Chapter three first illustrates the theoretical and realistic basis of promoting electron service in domestic civil procedure. Then it focuses on the discussion about the significance and the current conditions of popularizing electron service in domestic civil procedure. Chapter four mainly concerns the promoting way of electron service. The author tries to give a detailed systematic proposal about the procedure regulation of electron service, including the principles that ought to be followed and the measures that address the obstacles mentioned earlier in the article. |
