On Security Measure System With Chinese Characteristics

Security measure has the advantage in the defense of social security, protection of human rights ,which the traditional penalty do not have, so it is used in many countries. Actually, in China, there are a large number of security measure similarily, which does not to be systematized like the western countries, but scattered in the laws and regulations that have various natures. To some extent ,China's security disciplinary measure punishment plays an important role in crime prevention and defensive of the community, but there are a lot of flaws that needed to be improved in order to meet the demands of the times. The western security measures include security measures of human and security measures of things.Security measure of human are particularly important. In China, security measures of human are precisely rough, needed to improved urgently. Therefore, this paper will reconstruct China's human security measures, including the security measures in the existing Penal Code, to enhance its scientific and systematic.This paper is divided to six , approximating 30000 words.The first part, first introduce the concept and types of foreign security measures , then combing the security measures in the existing law of china , and outlined a whole host of its shortcomings,which lay a solid base on the discussions of specific shortcomings of these systems .The second part, to build China's compulsory drug treatment and compulsory treatment system in specific, according to "The People's Republic Of China Law On Narcotics" re-characterization of the compulsory treatment system, as well as the current system of compulsory isolation treatment is adjusted accordingly.The third part, put forward my owe views of the nature of institutionalization, and then summed up the asylum system, and put forward a sound proposal.The fourth part of the writing revolves around the controversial system of labor education and renabilitation. This section sum up the flaws of the labor education and renabilitation's available people and time,then sum up the flaws of the labor education and renabilitation's duration of the approval and implementation of procedures carried . Then come to the lifting of the labor education and renabilitation's.The fifth part disscuss the fate of receiving education and work-study education. Based on receiving education functions have some like in other security measures , and have many defects, so shouled be returned.Work-study education as a special way of educdte the juvenile delinquent, the actual effect has been recognized by the society, therefore, work-study education should be maintained.The sixth, based on the analysis of security measures,come to that our security measures should be criminal legalization.This section details the necessity and feasibility of the disposition of criminal legislation of China's security measures ,and disposition of China's security measures'objects and conditions , specifically set up the type of the security measures of people .
