In recent years, various kinds of food safety problems including"Sudan red"and"melamine"become the hot spots of the society. As a fundamental problem of human survival, the food safety issue is crucial to a nation's survival and development.After 4th draft, the Food Safety law of the People's Republic of China was officially implemented on 1st, June, 2009, which symbol the beginning of the systematic legislation in the field of food safety in China.It is notable that in the newly enacted Food Safety Law, the content of Surveillance and Assessment of Food Safety Risks is put as the second chapter near after the general principles. Therefore, the significance of the Surveillance and Assessment of Food Safety Risks should not be neglected.Surveillance and Assessment of Food Safety Risks is the significant scientific basis for enacting and revision of the food safety standards. In the field of supervision and administration of food safety, it occupies a significant position.This Surveillance and Assessment of Food Safety Risks system has been recognized in China comparatively late to other countries. It has not been completely established for economic, legislative and other domestic factors at present.This paper introduces the current situation and the development of the Surveillance and Assessment of Food Safety Risks system, using normative analysis and comparative analysis, explores the meaning of the quotation of worldwide constructing mode and experience of this system, and propose the improvement suggestion which is suitable to the domestic situation in China.The paper is divided into five sections.In the first part, the introduction section firstly illustrates the significance and background of the paper through analyzing the development history of food safety. Secondly, summarizes the research of the food safety at home and abroad. Thirdly in this part this paper puts forward the main idea, as well as the shortcomings still needs to improve.The second part is Surveillance and Assessment of Food Safety Risks and its evaluation system outline. At first it proposes the concepts of the"food safety"and"food safety risk", which suggests the necessity of the means of Surveillance and Assessment of Food Safety Risks. It further analyzes the means itself, including the theoretical foundation, content and features. Thirdly it puts forward that it is of great significance of food safety supervision system.The third part is Surveillance and Assessment of Food Safety Risks in china. It expounds the shortages of Surveillance and Assessment of Food Safety Risks in our country. It focuses on the causes of insufficience, such as vast territory, uneven development of commodity economy, food production, marketing model characteristics and other practical reasons. It is hard to monitor and assess the Family-run food business. The food safety risk assessment institutions are lack of independence and professionalism. The channels for surveillance and assessment information transmission is blockedIn the fourth part, it mainly introduces the establishment mode of Surveillance and Assessment of Food Safety Risks in the developed countries. By comparing food safety Legal subject, operating mechanism, the legal regulations, etc of theses countries with that of China, this paper puts forward specific methods to perfect Chinese regulatory system for food safety.The fifth part, combined with actual situation in China proposes the perfecting suggestion of Surveillance and Assessment of Food Safety Risks system in regulatory mechanism and legal regulation. Establish and improve the coordination mechanism between food safety regulatory authorities, especially the central and local government. Further strengthen the independence of the food safety risk assessment sector, Increase investment to improve level of analysis of food safety risk monitoring and evaluation agency,encourage enterprises to participate in food safety risk analysis. Pay attention to the role of consumer organizations and other social groups. Further improve the Surveillance and Assessment of Food Safety Risks-related mechanism, develop and improve the legal provisions of Surveillance and Assessment of Food Safety Risks. Coordinate and improve the relationship between food safety laws. Actively participate in establishing international laws and regulations of Surveillance and Assessment of Food Safety Risks.
