John Locke's theories on politics and law has been followed widely by western scholars since its birth. He's theories on power played an important role in the birth,development and practice of modern democracy. Our country has been in touch with John Locke's theories on politics since last century, and the systemic research on his theories on power begun at the born of new China. Especially in recent three decades of development of socialist legal system, we have got a great achievement of the research on Locke's theories on power. But becouse the late startup of research, we lack documents and materials of theories on power. And becouse excessive stressing the methods of class analysis on the research in a long term, there is much misunderstanding in our theoriy research on Locke's theories on power. In this thesis, I mainly use analytical methods by history and comparison, and consult a lot of correlative materials at home and abroad. Based on the reality and theory background of Locke's theories on power, I combine the development of the theory in and out UK, and make a comprehensive and systematic analysis of the theory, so as to get a exacter and deeper realization on the theory. Moreover, I research the theory under the background of our development of a socialist legal system, and I hope the thoughts of popular sovereignty, law first and authority control mechanism could promote our construction of socialist legal system greatly.There are six parts in the thesis:First: the social context of Locke's theories on power. In this part, it introduces the social context of Locke's theories on power. The development of economy caused a great change in every field of UK society in 17 century. Contradictions between politics and religion became more and more complicated and worse.Second: the substance of social contradiction and studies on its solution. In this part, it analyzes the substance of social contradiction in all spheres of the UK society, and introduce some politicians'solutions of it. In fact, the substance of social contradiction is the struggle for political power. The focal point of the struggle is that who possesses the power, and how to prevent power abuse. The politicians had thought about the solutions of political power struggle, and had designed different solving models.Third: the core of Locke's theories on power. In this part, it introduces the core of Locke's theories on power. It mainly includes: the origin of state power, the separation and subordination of power, the resistance righit of people. The theory on separation of power and resistance righit of people has been of great influence to modern development of political theory and practice.Fourth: unscrambling of Locke's theories on power in its background. This part is the emphasis of the thesis. In this part, it puts emphasis on an analysis on the main point of understanding for Locke's theories on power, which includes the starting point of the theory, the necessity on separation of power, the problems on jurisdiction, the relationship between state power and Sovereignty of the people, and the reason for giving people resistance right.Fifth: development and practice of Locke's theories on power. In this part, it mainly introduces the development and practice of Locke's theories on power in England and other countries(mainly France and the America).Sixth: the significance of Locke's theories on power for our development of a socialist legal system. In this part, it researches the significance of Locke's theories on power for our development of a socialist legal system, and mainly analyzes the thought of popular sovereignty, law first, and power balance, which is involved in Locke's theories on power and has positive significance for our development of a socialist legal system.
