On The Integrative Structure Of Bona Fide Acquisition

The integrative structure of bona fide acquisition was established by Real Right Law of the People's Republic of China . This paper aims to discuss three questions about it, which are what kind of theoretical basis the integrative structure of bona fide acquisition needs, whether the standard of good faith in the bona fide acquisition of real property is as same as that in the bona fide acquisition of movable property, and what kind of limits the integrative strcture of bona fide acquisition will meet in the system of China Real Right Law.The bona fide acquisition could be formulated in different forms, which is based on different theoretical backgrounds. For the integrative structure, the theoretical basis should be the theory of juristic act and the principle of protecting reliance, which will be discussed in chapter one. The question about Good Faith will be discussed in the second chapter, in which the Good Faith in the bona fide acquisition of real property will be distinguished with that in the bona fide acquisition of movable property. In addition, either real property or movable property could be stopped from being acquired in good faith by antagonistic force of the registration , which will be analyzed in the third chapter of this paper. In the end, the fourth chapter will conclude the viewpoints of this paper.
