Being important basis for jurisprudential research, rights are the means given by law to gain interents. People's free wills, which cannot be interfered in principle, should be obeyed when exercising rights. However, all rights have bounds, which are exercised by person comparatively. Thus, every right should be exercised within a certain legal range. This thesis, starting from bounds and protections of individual rights, and taking issues deriving from cellphone identification policy, discusses individual rights, as well as analyzing the limits of individual rights and legal protection from the view of jurisprudence.In part one, the thesis gives an overview of rights'basic intension from its etymology and essence, and introduces different kinds of rights according to different division standard. In part two, as for enforcement of cellphone identification policy, people regard it as violation ot civil privacy and communication freedom. In the thesis, starting from rights limits, the writer views that public interests are prior to individual ones, and obeying the principle of honesty and good-faith, the exercise of individual rights cannot violate others'maliciously. Moreover, individual rights have limits, and the enforcement of cellphone identification policy does not violate civil privacy and communication freedom.In part three, our nation should limit the rights bounds by consummating laws and regulations. In terms of privacy, besides the present laws and regulations, individual information protection law should be formulated and consummated so as to clarify the range of individual information and protect it. As for civil communication freedom, legal extensive explanation should be made to clarify its range. Meanwhile, laws should be revised and Telecommunications Act should be established to improve the regulaitions for sentences of violating communication freedom, so as to solve the problems of its limits.Guiding people's behaviour, rights limits make it a certain guidable and predictable. Therefore, rights limits should be clarified by laws, and with definite principles, people would enjoy the real rights within the legal range. |
