The Chinese Punishment System Reform

According to the native law setup, the longest term of Imprisonment is 15 years. Also, there are two limitation for Life Imprisonment. The upper limitation is 22 years, and the lower one is 15 years. However, in general practices, one criminal who has been sentenced to the penalty of Life Imprisonment, could always be reborn and have the freedom back to the social life after 15 years'prison life. As to the Probation of Death Penalty, the relevant limitation is setup as from 24 to 17 years'Imprisonment execution, in addition with the reality that seldom of the criminals who sentenced to Probation of Death Penalty be executed Death Penalty finally.This penalty execution situation have caused a serious of problems, such as linking up problem between one punishment system from another, the conflicts among different punishments, the lack of determent to the crimes, and making the victims inacceptable to the result of judgement. Meanwhile, the problems mentioned above counter act on the judger and judgement itself. Furthermore, this situation depending on the execution of Death Penalty via the demands for punishing the crimes from the people calling for justice and retribution could not decrease the number of crime and the execution of Death Penalty effectively compared to the western countries'punishment system setup.Making the Death Penalty the most serious punishment of the punishment system, it is far more strict than the next level in existing law setup. Assume that, left is death, right is freedom after 15 or 17 years, but null in the middle. In this frame, it is difficult to achieve the aim punishing and preventing the crimes. So, reform is needed, including increasing the upper limitation of Imprisonment, extending the testing period of the Probation of Death Penalty, Life Imprisonment recovery, etc, in order to abolish the Death Penalty.Anyhow, punishment system reform is really a complex project. Long term of imprisonment could also cause a serious of problems, for example, increasing the cost of prisons, criminals'introjecting to the society after release, and so on. That is to say, reform is needed not only in the punishment system field, but also in the punishment execution field.
