| "The People's Republic of China Labor Contract Law" be effected since January 1,2008, "The People's Republic of China Labor Contract Law Implementation Regulations" be effected from the September 18,2009. These two laws will effected enterprise human resources management, in particular, it is a profound impact to the large number of labor-intensive enterprises in coastal areas. Therefore, enterprises must pay attention to the labor contract management, review their company existing regulations and labor contract management against the two laws and implementation of corporate existence of the labor contract management issues that may arise from the potential risks and take corresponding measures for improvement to enhance labor contract management, to avoid the labor dispute arose which caused unnecessary losses to them.This article focuses on the labor contracts relevant theory, and then analyse the status of labor contract administration and evaluation of the labor contract, to find the problem of labour contract management in COBY, and give suggestion to the company. To fully elaborate this theme, this paper review the organizational structure of COBY as start, and then analyse the status of human resources to identify COBY's human resources characteristics; By reviewing COBY's labor management rules and regulations to find the conflict with "Chinese Labor Contract Law of the People's Republic" and other laws and regulations; by COBY's labor contract management analysis and evaluation of the status to identify COBY in the labor contract management problems, and then review four typical labor dispute in COBY to verify the above issues.At last to address these issues and put forward COBY companies to upgrade the labor contract management strategies, mainly to improve their rules and regulations, to enhance staff recruitment management, and improve the content of the labor contract, strict implementation of labor contracts to lift procedures, improving employee benefits. If all of these measures be implemented in the COBY, I believe it will reduce the occurrence of labor disputes and improve relations between employees and enterprises, so as to enhance business management and economic benefits.The problem of labor contract management is not only in COBY but also in labor-intensive enterprises in developed coastal areas, so the study of this issue has universal relevance. |
