Research On Legal Protection Of Personal Information: First Case Of Manhunt As Example

The development of information society gives rise to a number of conveniences, broaden people's accesses to information. However, it allows us to see not just smile, there has also been illegal to collect personal information, disclosure, use. personal information is violated, not only undermines the rights of the main body of information, but also causes serious harm to society. As our county in the protection of personal information is mainly indirect, no specific legal protections, and the legal protection system has not been set up, the issue of infringement of personal information has always been controversial. In view of the importance of protecting personal information and necessary of communication of information, the author takes the first case of "man hunt" as an example, combining the merits of personal information-related issues analysis to explore the experience of some worth promoting, wish to contribute to the protection of personal information and information communication to seek a reasonable balance.This constituted mainly by three, from the first case of manhunt, analyzes the concept, characteristics, classification of personal information; discusses whether the tort of disclosure of information during the case, and describes the limits of disclosure of personal information, further analyzes privacy, the right of privacy, personal information, the right of personal information the basis of information protection and other concerning issues, puts forward the concept of protection of personal information.Section I of the article makes a brief overview of the case, is focused on the basic issue concerning personal information, views and reasons during the legal profession on man hunt first case, and expounds author's personal information, the right of personal information, domain of personal information of right's object and related issues, discusses contact and distinction between privacy and personal information, between the right of personal information and the right of privacy. Section III based on the current actual situation, puts forward recommendations of the personal information legal protection, and discusses the protection of personal information outside the law.In conclusion, the personal information protection and exchange of information dissemination should be a reasonable balance to meet the information society development.
