| The arising of administrative discretion standard is to limit administrative organizations to abuse administrative discretional power, which aims at regulating administrative actions. This paper focuses on restrictions of action of administrative discretional power firmly, preventing it from abusing. The author's thinking is on the basis of this. This paper begins by the basic theory of administrative discretion Standard, analyzing the theoretical principles, functions, nature, an so on, which makes us a moleskine of administrative discretion standard. A lot of administrative discretion standards have appeared in our country executive practice recent years, because of notions of law-based administration resulting in greater public awareness, carrying out by central government, necessity of executive practice. But there are some problems. Therefore, the syetem of administrative discretion standard in our country must be standardized, which needs guiding principles, proper formulation bodies, extended application scopes, reasonable formulation procedures. At the same time, rational administrative discretion standard needs perfect a control system, which contains an interior control from administrative organizations and an exterior control from organ of state power, judicial organ and public opinions. |
