On The Mode Of Legal Modernization In China

Now China is in a critical period of social change.Its goal for promoting the political, economic and cultural life of the comprehensive modernization of society. Legal modernization is one of the most important proposition. Legal modernization is the process of transforming the traditional legal system to the modern one, its goals for the modern rule of law. Because of the huge challenges and opportunities, modernization of China's legal system is an arduous historical task. To continue to strengthen the socialist legal system, building the socialist market economic development, social progress and the new situation of globalization, modernization of socialist legal system, can promote the overall development of society, better for promoting China's social changes, faster implementation of our modernization.After doing a comprehensive interpretation of the modernization, rule of law and legal modernization,this paper have a complete description of the modernization of the Chinese legal system. Also have summary of the history of modern legal system in the western countries, put forward three models of modernization on the rule of law, and analyze the characteristics of these three models with their respective advantages and disadvantages. On the basis of modern Chinese legal system that can not send a one-time large-scale hopes to complete the legislative campaign, the legal system modernization legislation must be emphasized the balance between the speed, scale of legislation and quality, efficiency of legislation, emphasizing the balance between the social,political development of law and economic development. Ultimately reflect the Chinese characteristics of the birth of the Chinese law.I think we should construct the ideal picture of China's own laws, or even China's own future and the Chinese ideal picture of the world's future in three areas,which is to re-define the legal definition, method of transplantation and the law of local resources and build the relationship between the belief in China's legal efforts. Although China's legal modernization have been some successes, there are deficiencies, especially in the Soviet legal patterns in deeply negative impact of the legal system.So we should accept the lessons, learn experience and leave the rule of law with Chinese characteristics modernization of the construction process in the future. This paper discusses the present stage in China's strategy of building a socialist country ruled by law,and put forward some policy recommendations in the level of practice.
