The Case Study On Well-known Trademark Dilution

Well-known trademark, as an intangible asset of an enterprise, is the outcome of concentrated business owner, embodies owners'hard work and good business reputation, and also a wealth of the whole society. Well-known trademark has high degree of visibility and attention and means a huge commercial value, which lead to that many well-known trademarks become the main target of the infringer. Among the violations, the dilution is a very special act violation, and traditional protection model has not to regulate it. Therefore, the well-known trademark anti-dilution protection mode arises at the historic moment.In recent years, well-known trademark dilution phenomenon occurs repeatedly in China. China's existing laws can not radically curb the behavior of well-known trademark dilution, on the well-known trademark anti-dilution protection. As the WTO membership nearly a decade, China's economy is gradually integrated into the world economy. With economic globalization and integration process and in the development of national economy and foster their own brands, we have to follow the common rules. In the case of well-known trademark anti-dilution protection in developed countries, we can not be in a backward state, and must take various measures to curb the occurrence of the phenomenon of well-known trademark dilution, protect well-known trademarks, and safeguard the interests of stakeholders.This paper introduces Lenovo (Beijing) Co. Ltd, as plaintiff on the "Lenovo" trademark dilution trademark disputes, and proposes a few issues related legal in this case. And then analyze legally the behavior of well-known Trademark Dilution from the theory, including manifestations, causes and hazards of the well-known trademark dilution acts. Finally, for the issue of the well-known trademark dilution, I put forward some suggestions from the legal, management, business and consumers.
