With the continuously deepening of the reform and opening up, the social gap is growing and the social faire is become a serious problem. Because of various defects the current social security system can't reflect the social justice. How to establish the organic connection between the social security system and the development of the market economy and democratic politics is a problem that every responsible citizen should be concerned.Marshal, a famous British sociologist, proposed the civil social rights from the perspective of the citizenship. According to this theory the social rights should be considered as the deserve rights and the government should bear the obligations of provide a variety of welfare programs.This theory require the government take more active actions such as social welfare programs for the poor people, with the hope that it can relieve the contradictions between the development of capitalism and the equal citizenship. The author try to discuss the problem of the construction of the civil social rights in china from the prospective of Marshal, in order to construct a new social security system. The main difference, between the new and old civil social rights and social security system, embodied in the relationship between the rights and obligations. This theory enlighten us that we should more concerned about the equality and the overall balance between the rights and the obligations,in the process of the construction of the new rights and the system, with the hope that the new construction of the social security system could overcome the weaknesses of the present system,ensure the realize of the social fair and create a better environment for the development of market economy.
