The Research Of Procedure Of Administrative Supply

The nomocracy of administrative procedure is an important part of contemporary administrative democracy, and the administrative supply procedure marks an nation's degree of civilization. As an essential part of administrative procedure, the Chinese administrative supply procedure has already made great progress. However, the regulatory and unified system of administrative supply procedure has not established yet. Most of the current theoretical research and legislative practice of China focus on adverse administrative action such as administrative penalty and administrative enforcement, while ignores the beneficial administrative action such as administrative supply and administrative reward. This phenomenon is detrimental to the implement of administrative supply. Furthermore, the increasing lay-off, unemployment and other poverty phenomenon poses a challenge to the "legal blank" of administrative supply. Therefore, the study on the relevant theory system of administrative supply is meaningful in both theoretical and practical area.Through historical analysis, comparison analysis and empirical analysis methods, this thesis, taking the study of administrative supply procedure theory as the mainline and integrating the implemented provisions of "Administrative Procedures in Hunan", the not published "Administrative Procedural Law" (in examination), the "Social Assistance Law"(requirement for comment) and the existing administrative supply legislation, points out the existing problems and provides suggestions on the improvement of administrative supply procedure.There are four chapters in all:the first chapter states the contents, value, fundamental principle and basic system of administrative supply procedure; the second chapter deeply analyses the implementation of the administrative supply procedure combing with the current relevant administrative laws, regulations and policy; the third chapter, based on foreign laws and regulations concerning disasters, reviews the "5.12 Wenchuan Earthquake" in 2008, the "4.14 Yushu Earthquake" in 2010 and other disaster relief situations and analyses the special administrative supply program-disaster supply procedure; the fourth chapter puts forward that our country should improve the administrative supply procedure in order to perfect "safety net" on citizen basic life.
