The Research On Law Of Property Right The Circulating Of The Land Contractual Management Right

"Law of the people's republic of China on property right" has been put into practice. It declared the property right of the Right to Land Contractual Management, and established the status of the Beneficial Property Right. Meanwhile, it provided a new angle for us to improve the circulating system of the Right to the Contracted Management of Rural Land. The stabilization of the Circulating System of the Right to the Contracted Management of Rural Land and the establishment of long-term mechanism of this system can maintain the rights of land contractors, which are the base for stabilization and development of rural area and are also the important theme of harmonious rural area.However, the recent practice of Circulation of the Right to the Contracted Management of Rural Land exposures many problems of this system. How to analyze and improve the Circulation of the Right to the contracted Management of Farm Land from view of "Law of the Property Right" becoming a new problem.My thesis tries to analyze the property right and its effect of Right to the Contracted Management of Rural Land to expand relief way in the process of Circulation of the Right to the Contracted Management of Rural Land. Besides, to deny the right to mortgage land contractual management approach circulation combined with the Right to Land Contractual Management building sharing system is proposed to allow the right to inherit land contract management, in order to improve the land contract on the circulation of management rights of useful recommendations. The improvement of Land Contract Management Right Registration System, supplemented by non-contracted land management right of appeal Settlement Mechanism, more effectively protect the legitimate interests of land contractors.
