The Study On The Legal Issues Of Supervising Chinese Financial Holding Company

In the 20th century'ends, the world financial industry presented the tendency of mixed management, some developed countries started to allow their financial institutions to take different financial businesses in banking, security, insurance, trust fields and so on. In the wave of financial globalization and integration, the finance holding company becomed one of the main configurations of organization.The finance holding company itself has the superiority of the economies of scale,it could save cost and realiz optimized disposition of the resources through the way of classification, conformity, plan and mix to the internal resources. But because the finance holding company's scale is huger, its management domain is widespread, the links of equity s are complex and so on, their unique risks are more more serious compared to other finance configurations of organization. At present, although our country has already presented many types finance holding companies, the financial industry system is still "separated businessd,separated supervision", and our country does not have nearly legislation aimed at the finance holding company.Therefore, it is very essential to establish and improve legal system of the chinese finance holding company's supervision.On the base of researching the finance holding company's development background, this text makes legal definition of the finance holding company, analyses the special risks of the finance holding company and the present situationg of chinese finance holding company's development and supervision, summarizes some developed countries and areas' supervision modes of the finance holding company. Combining with chinese financial industry experiences and present financial legislation, the text also puts some proposals to establish a framework of system,which is more comprehensive,systematic and rational for the supervision of our finance holding company.
