System Research Of Chinese Rural Bribery Phenomenon

China is a country with the majority of the rural population. The stability of rural areas means the country's stability, the development of democracy and constitutionality in rural areas means the development of the whole country. With the aim to develop democracy and constitutionality in rural, the government began to explore the development of rural autonomy from 1980s. The development has made great achievements. But in recent years, vote-buying phenomenon in the election has emerged in some rural areas, and has become worse. With the great deficiencies in the system of rule by law in our country, we should study the system defects and the relationship between it and vote-buying in rural areas, and take actions to improve the system to curb bribery and corruption in rural areas. The author believes that the topic of the research has strong theoretical significance and practical value.This paper is divided into five chapters, apart from the introduction and conclusion . It mainly introduces the origin of the rural electoral system and the applicable law in rural China, reveals the bribery phenomenon and its harm, analyzes the motivation of the bribery, and analyzes the system causes of China rural bribery, finally puts forward the system countermeasures in rural China to restrains the bribery:The first part is the origin of Chinese rural electoral system and the applicable law. In this part, First of all, it introduces our village committee election system as a sub-system of villager autonomy system with the development of villager autonomy system; Secondly, the part introduces the currently applicable to China's rural election law; The last, the part introduces China's rural electoral system in the country carried out by the status quo at present.The second part is Chinese rural bribery phenomenon and its harm. The first, it describes many Chinese rural election many phenomena, and carries on the preliminary analysis; Secondly, it analyses the characteristics of rural bribery phenomenon and the latest trends; Finally, the harm caused by the Chinese countryside election appear more bribery phenomenon were analyzed.The third part is China's rural buying behavior motivation research. Chinese rural bribery phenomenon has deep social reasons, the briber and the bribee in " the game of bribery " both have their own motives. It not only expresses a kind of value criteria, reflecting democracy, rights, freedom, equality requirements, but also has strictly formal characteristics. The rule of law in the modern society has high demands on legislation, law enforcement, jurisdiction and law aspects of the supervision. But Chinese current system has flaws. Lack of legal system about vote-buying in rural areas leads to defects in regulation; Weak supervision results the election monitoring to invalidity; Judicial bribery cases in rural areas are not accepted; Supervision of village cadres are not independent by judicial authority indirect to indulge the vote-buying in rural areas. Then measure the costs and benefits make the vote-buying "rational" happened.Part fifth is the measures about legal system to curb vote-buying in the rural areas of China. To deal with the rural vote-buying phenomenon that is more and more serious, I suggest to improve legislation and fill the legal gaps in the vote-buying in rural areas, improve the supervision mechanism, cut the channels about the recovery of the cost of buying, try to improve the education about the law popularization, enhance the notion about the rule of law in order to resist the temptation of bribery and corruption, and vigorously develop the rural economy, enhance the sense of democracy to finally eradicate the vote-buying phenomenon.
