The Study On Anti-monopoly Regulations Of Our Country's Enterprise Concentration

Enterprise concentration is bound to arise an economic phenomenon in the process ofmarket competition. It is an important and efficient way to develop new markets, enhance thecompetitiveness of economies and form economies of scale. However, concentration is adouble-edged sword. On the one hand, appropriate concentration plays a good role in thequality growth of enterprise and promotes the market economy. On the other hand, excessiveenterprise concentration is possible to form dominant market position and anti-competitivemonopoly, and brings out the unfair competition for other enterprises. It is not conducive tothe maintenance of economic order. The timely introduction of Anti-monopoly law plays aguiding norm role in building our country's good market order and promoting the healthyoperation of the market economy. However, the regulatiogns of anti-monopoly law is notperfect. Lots of entities of content and procedural operations are undetailed, which isinconvenient to law enforcement. So from the perspective of Anti-monopoly regulations, thepaper takes a reseach in the conduct of enterprise concentration. I hope to provide some usefulreferences to set up and perfect the regulation system of concentration.This paper is divided into four parts. The first part is the introduction of the basicconcept of enterprise concentration. It introduces different kinds of concepts at home andabroad, elaborates the classification of enterprise concentration, and analyses both positiveimpacts and negative impacts on competition. Finally, back to the dialectical relationshipbetween the anti-monopoly regulations and the enterprise concentration, we reach aconclusion that concentration requires both limited regulations and moderate toleranceregulations. The second part focuses on the contents of the regulations on enterpriseconcentration from China's current anti-monopoly laws and regulations, and also pointes outcertain imperfect rules in the legislation. The third part stresses on foreign legislations, which mainly introduces their specific system design. The fourth part, based on the specificcircumstances of our country, learns from the advanced experience of foreign legislations, andraises several recommendations of improvement.
