Study On System Of Police's Responsibility In Law Enforcement

Based on the methods of theoretic analysis, the paper firstly illustrates the three macro-concepts, that is, responsibility, lawful responsibility and administrative responsibility. Then it points out that police's responsibilities during law enforcement are those lawful responsibilities induced by administrative irregularity, improper administration, trenching the legal rights and interests of those who are under the management of the police or tampering the State's or the public's interests. It also make a further discussion on the composition, type and significance of the police's responsibility during the law enforcement.After illustrating the concepts and significances of the police's responsibility during law enforcement, this paper reviews at large our country's Hong Kong's, the USA's, the UK's, the France's and other main European and American country's obligation system and supervising system of law enforcement. It finds out the merits and experiences of these countries or areas. Furthermore, it makes a textural research on the lawful foundation and contents of our country's police's responsibility of law enforcement. The current situation indicates that the relative laws and regulations are not enough, and those that exist are with low administrative levels, that the procedures that run those offense are not normative, that there are some problems in the responsibility running system because of unpublicity of the running procedure and result.At the end, the paper suggests that we should improve our police's responsibility system in law enforcement by thoughts renovation. Only by reforming the policing administrative system, strengthening the supervision on law enforcement, rigidly running police's responsibilities in law enforcement, pushing the obligation system in law enforcement do we can reform and improve the running system of law enforcement responsibility, achieving the purpose of restricting power with responsibility and responsibility accordance with power during law enforement.
