After World War II, war is inevitable,although abandoned and forbidden in International Law. International Law restrict the means and methods of war,and protect war victims. The traditional laws of war developed into the modern laws of war,through the baptism of the post-war and a large number of international practice such as international trials of war criminals. Just war and justice of war constitute the justice in the course of war. Hold the responsibility for the war stands for the justice after war,that is an essential part of laws of war.and accountability for war is the responsibility of the post-war justice, is also essential to the laws of war. "International Criminal Court" is the latest results of how to punish war crimes and hold responsibility for the war. It is a growing concern of the international community against the common interests of mankind's war crimes embodied. Through the redefinition of war and war power, the laws of war to determine the scope of the adjustment, a detailed analysis of national responsibility and individual responsibility of the elements, the form of commitment, as well as ways to execute, put forward a new concept of national responsibility and individual responsibility. As the war responsibility's main accountability mechanisms including international justice and national justice, but also international organizations, national civil relief,compensation mechanism for victims, the international community's moral condemnation, and so on. It is necessary to improve the system of legislation and execution for war accountability,play the role of international organizations, combination of national civil relief and compensation mechanism for victims,with the moral condemnation of the international community,in order to punish war crimes better, hold war responsibility and restore justice after the war.
