The Legal Analysis On Protecting The Right To Net Privacy In China

With the development of the internet technology, our mode of producing and living has been changing swiftly. It makes our life become quick and convenient, at the same time, it also makes our life become"transparent". Because of the internet's openness, sharing and convenience, our right to privacy is easy to be infringed, and it brings a threat to protect the right to privacy. In recent years, the torts of the right to privacy in cyberspace happen frequently. However, due to our research on the right to net privacy isn't in-depth, these torts cannot be solved legally, and it becomes a new task to legal theory research.Now, many scholars, who come from different countries and regions, attach importance to research on the right to net privacy, and gradually they find the suitable system which is fit for their national or regional conditions to protect the right to net privacy in reality. By contrast, it is later to research the right to net privacy in our country, the relative legislation is imperfect, and many tort behaviors cannot be impeded. Therefore the further research on protecting the right to net privacy will have vital significance to the future work.In our country, we don't have the tradition of protecting privacy, and the behaviors of infringing privacy are still included in the behaviors of infringing reputation. However, with internet developing and popularizing, we realize the significance of protecting privacy in the current. In addition, many countries and regions enact rules and regulations to protect the right to net privacy. Although they are different in the legislative purpose and the protecting pattern, their law are effective to protect the right to net privacy in these countries and regions. After analyzing the protection of the right to net privacy of other countries and regions, there are some legislative proposals to protecting the right to net privacy in our country. Among them, there are three aspects which should be improved in our legislation. The first is"Use law-control and self-control in China, but self-control is subsidiary". The second is to improve substantive law and procedural law on protecting the right to net privacy. The third is that we should pay more attention to protect net privacy of the special subject. This paper tries to appeal countrymen and legislature's attention to the right to net privacy in our country through legal analyzing the protection of the right to net privacy.
