Now, the cases of crime by taking advantage of duty in police have occured from time to time. Some have seriously damaged the image of the institutions and their police. So, to punish and prevent the crime by taking advantage of duty in the police of reeducation-through-labor, has great significance to develop the institutions healthly, orderly, rapidly and safeguarding social stability.As the re-education through labor has not yet be legislated, the main legislative authority for the prevention of crime by taking advantage of duty in police of reeducation-through-labor is " The Way in re-education through labor of People's Procuratorat" Departments in theory and practice studied little. This article focused on the prevention of crime by taking advantage of duty in police of reeducation-through-labor. It is hoped that through this issue to clarify the rationale and legal basis, to study the status quo and reasons for the prevention of crime by taking advantage of duty in police of reeducation-through-labor, to sum up our mechanism in reeducation-through-labor, to plug the system deficiencies. This article believes that the keys to prevent the crime by taking advantage of duty in police of reeducation-through-labor are: firstly to perfect the internal supervision mechanism with a power restrained by another, and the long-term mechanism preventing the crime by taking advantage of duty, then in order to strengthen the discipline and supervision of police;then, to improve the external supervision mechanisms of surveilance network, to establish the system of a clean supervisor and making public prison affairs to inmates, and to open channels of supervision by public opinion; thirdly, to strengthen the system of appraisal on people, to strengthen the education and training of prevention and punishment of crime by taking advantage of duty, and to explore and implement a new personnel management mechanism; the last, to improve the safeguard mechanism of treatment for police. Only then , can we prevent the corruption in rights according to law for reeducation-through-labor and promot the police to discharge their duties correctly.
