Study On China's Legal Protection System Of Urban Forests

Along with the fast development of China's society and economy and the continually rising of China's urbanization,cities are facing a series of environmental problems.Urban forests have a unique function which improves environment in the course of our constructing ecology cities.As the important method of resolving the conflicts between the development of cities and the environmental protection,urban forests have become the important guide line which scales civilization and the urban capacity of continually development.However,China's studies on urban forests are very late.There are lots of problems in the urban forests constructions and the legal protection system according to it.The author expatiated the existing legal protection system of urban forests,and analyzed the problems thereof,including legislative disfigurement,implementation system of law in arrears and the distempredness system of the Public Participate.The author brought environmental law,continual development theory,ecology and ethic theory, environmental economy theory to the study on improving the legal protection system of urban forests.The author used advanced experience from the developed counties for reference, such as the United States American and Japan,and summarized that China's protection legislation of urban forests shall comply with the principles of rational development, logical exploration and integrated construction.The law shall include many systems such as property,programming,sorting and keeping,evaluation and inspection, collected management,compensation for ecology,lopping license,implementation of law and monitoring inspections,the system of the Public Participate,innovation and financing. The scientific legal liability should be established which includes three types,namely criminal liability,administrative liability and civil liability.The author strived to improve China's legal protection system of urban forests so as to construct and continually utilize urban forests,and develop ecology civilization in cities.
