On "the Crime Of Huge Amount Of Property Of Obscure Origin" And Its Replacement

A number of debates and arguments have been launched,in both academic and practical departments,on the crime of huge amount of property of obsure origin,since its legislation in 1988."Criminal Law Amendment(7)"has enhanced its maximum sentence to ten-year-imprisonrnent,which is considered by many scholars as a reflection of anti-corruption efforts of the government.However,controversial arguments on the advantages and disadvantages,retention or abolition of the crime are still far from being cleared.In order to further the understanding on the crime of huge amount of property of obscure origin,this article deliberates on both macro-and micro-level contemplation and analysis of the crime of huge amount of property of obscure origin,mainly on the following three aspects:1 ),legislative history and comparative analysis;2),legislative deficiencies and jurisprudential analysis;3),legislative value and legitimacy,and based on which come up with the suggestion of establishing the crime of failing to declare property,together with the dissertation of its concept,content,legitimacy and its essential prerequisite systems.
