The Parties' Statements On Civil Action

The Parties' Statements have been stated explicitly as independent evidence in our country,however,our country distorts the relationship between impersonal truth and the truth of law during the judgments,pursuits the efficiency unilaterally,ignores the course of justice,lack of lawsuit ideas considering procedure of justice and as a result The Parties' Statements,in our litigation,is in conflict with the role assigned by law.In this paper,on the basis of clarifying the basic theory of the party's statements system,we will further analyze the legislative states of this system,problems in practice and the causes of these problems,and give some specific recommendations to improve our country's party system through a comparative analysis of some scientific system settings at national and regional institutional level and borrowing scientific and rational experience.This article is divided into four parts on the parties' statements system:The first part,we summarize the Parties' Statements,firstly we analyze the main viewpoint of domestic academic's connotation on the Parties' Statements,redefine the meaning of it,the characters and feathers,the function,the classify,the relationship between the Parties' Statements and lawsuit mode.The second part introduces our country's parties' statements system,we elaborate and demonstrate in detail the legislative status of our country's parties' statements system, problems exist in practice and the causes of these.The third part introduces and analysis China's extraterritorial system and its inspiration of our country.This part contains information about the scientific system set-up and successful experiences in the extraterritorial regions and major countries,and we can gain some insight by assessing the Implications for China.The fourth part perfects specific ideas of Parties' Statements system;we bring forward some specific proposals t on the basis of the first three parts.
