Research On The Legal Application Of Oil Pollution Damage Resulted From Collision Of Ships In China

With the sustained,rapid and healthy development of China's economy,the demand of oil this strategic material shows a rapid growth.China has become an oil import country since 1993,when her oil demand has been more than her production and 90%of the imported oil was carried by sea.Although modern navigational technology are much higher,it is still difficult to avoid collision of ships,which usually cause significant damage to property or injury to persons and other seriously consequence.In recent years China's coastal oil pollution damage caused by ships collision happens frequently,but there is still dispute on the legal application of the said cases.Therefore,this article intends to compare the legislations on oil pollution damage between international conventions and make analysis on related regulations of China, then provide suggestions for settling the dispute arising from the compensation of oil pollution damage caused by ships collision and with a view to improving the legislation on oil pollution damage in China.Chapterâ… makes an overview of China's coastal oil pollution damage status quo caused by ships collision and introduces the characteristics of the oil pollution, revealing the existence of the problem in practice and further clarify the direction of writing of this article.Chapterâ…¡introduces the international legislation of oil pollution damage including the efficient international convention and treaties,and then makes an analysis on related regulations of China.Chapterâ…¢concludes the application of law in different kinds of oil pollution damage based on the analysis in Chapterâ…¡.Chapterâ…£after the problem whether applies the domestic regulations of China or the international conventions in different kinds of oil pollution damage was solved,the author will focus on the disputes in applying the domestic regulations and provide suggestions and methods to solve them.Chapterâ…¤provides proposal for application of law in oil pollution damage caused by ships collision and future legislation on oil pollution damage in China based on the above analysis.
