Research On Meteorological Intellectual Property

With the rapid development of the economic society,various industries and the public depend more on the meteorology.The potential value of the meteorological data,product and service is much more obvious than ever.Though a series of problems about meteorological intellectual property have become the bone of contention,the scholars haven't reached consensus.Some of them believe that the meteorological data,product and service should be protected by the intellectual property law while others don't agree.They consider the meteorological data,product and service as public products and these kinds of products should be used by the public without any restriction.According to the comparison between the meteorological data,product,service and the intellectual product,we'll find the former also belong to the latter.Concretely,the meteorological data is an object of right of discovery and the meteorological product and service are the objects of copyright.When building the intellectual property law system,we aim at both goals:to protect the intellectual creators and to promote the extensive spread of the intellectual products in order to realize the social cultural development.Though the meteorological data,product and service serve the public as the commonweal,they have the private character of the intellectual product.Furthermore setting up the meteorological intellectual property law system is also a choice of the social value.Facing the infiltration of commercial meteorological service, it will help to invent benign competition,attract the advanced technology, and enrich national meteorological services.But at present,much has to be done before the consummation of the meteorological intellectual property, such as the reform of government and the progress of commercial meteorological service.And the law finally has to reach the balance between competition and anti-monopoly.
