Study On Ideologies Of Rule By Law About The Book Of Lord Shang From The Angle Of The Ideology Of State Affairs Management

The Book of Lord Shang ,also known as Lord Shang ,reflects the thoughts of Shang Yang and latter scholar and other Legalists'ideas ,during the later period of the Warring States .The edition research about The Book of Lord Shang includes various block-printed books, corrected copies, comments ,as well as the translated editions, The research are mainly philosophy elaborations from the angle of the historical theory of evolution and the human nature theory .This paper, depending on the foundation of predecessor's text research, interpreted the theory of Rule by Law, from the angle of the ideology of state affairs management. The process of realization to manage state affairs is from Govern to Rich, to Strong, to King. Govern is the first step, and Rule By Law is the core wants for Govern, also is the lowest request to realize the rich state and strong army. Rule By Law is decided by evolution of society and the human nature .The law is the body, the punishment for uses, to supervise the people agriculture and war. to realize the rich state and strong army, in the end to one world. In order to realize Rule By Law, The king must not forget law for an moment, observes the national affairs to make law, and uses the heavy penalties to stop crime. Therefore, the realization of Rule By Law must rely on"three handles" that are "Using the law", "Setting up the Credit" and"Arbitrating the power"."Arbitrating the power"is the core goal.This article is divided six partial elaborations: First, the foreword theory, introduced the present legal thought research about The Book of Lord Shang ,at the same time, introduces the concept of the ideology of state affairs management . It means a synthesis knowledge system, such as theories, thoughts, which about how to rule a nation in ancient times in China. Second, analyzed the world at that time, namely from the social politics, the economy and the social stratum change. Outlined the time characteristic, and analyzed unique geographical environment of the Qin and it's political reform tendency. Third, entered the ideology of state affairs management. to find it's structure and the system, thus analyzed the position of Rule By Law in the ideology of state affairs management. On the other hand, Contrasting with the Confucians, Taoism, the Monist school and the famous, discusses"the origin thought of The Book of Lord Shang Fourth, analyzed the theory of Rule by Law comprehensively. to know the definition of law ,to understand the basic request of Rule By Law and how to realize the Rule By Law. Fifth, taking as a conclusion, sorted out the appraisals on the Rule of Law from the angle of the ideology of state affairs management in the history, explained the modern model significance of this article studies, and pointed out this article studies still remain some insufficiencies.
