The Discussing Of Some Problems In Our Country's Mediation System Of Administrative Lawsuit

Chinese abstract: Our country's administrative procedural law article 50 regulating: when people's courts trial administrative cases, mediation is forbidden. There are some contradictions between the regulating and judicial practice. The phenomenon must arouse our self-examination: judges usually mediate between both sides interested party. This article is aimed at the problem: the mediation is whether or not suitable for use in administrative lawsuits. Basing on the value of administrative lawsuit, my thesis has analysis the legislation basis and obstacle of using mediation in administrative lawsuit. I come to a conclusion: it is certainly need and can be carried out to build administrative mediation system. After these problems having been resolved, my thesis has studied the following problems: administrative lawsuit basic principles and lawsuits'range of using mediation.
