On The Legal Control Over Police Power

Police power are important component of the state power. They are of great significance to the maintenance of social order and to ensure social stability. But recently, the abuse of the Chinese police power has become a major issue in contemporary Chinese society. In this paper, the legal control research on the police power is studied. The paper is divided into four sections:The first part is to outline the police power. First of all is to review the history of"police"concepts in the WEST and in CHINA. On the basis of accurate understanding the meaning of the"police", this part elaborates on the definition, attributes, purpose, task, range and characteristic of the police power, to high light its public welfare.The second part is to reflect on the abuse of Chinese police power in values. From the evolution of Chinese police history, form the Party's security departments to the government police organ, the unification of dictatorship orgaron leads to the abuse of Chinese police power.The third part is the mecessity to control police power. From the western contritutional theory to the demands of Chinese people dictatorship polity, from the requiements of law to the characteristics in the course of police rights abuse, it's all required to control police rights.The fourth part is the paper's theme—legal control over the police power. It mainly starts from two aspects—the control of the legislature separates the powers of police power mainly through legislative. The control of the judiciary starts from the control of police rights by the procuratorate and the court according to China's current situation.
